Article 1 – Definitions
- Entrepreneur: the legal entity that sells a digital family planner (tablet + application subscription) to consumers via the website.
- Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with the entrepreneur.
- Product: the physical tablet that is part of the family planner.
- Service: the digital family planner application made available through a subscription.
- Distance contract: an agreement concluded via the website, without physical meeting between consumer and entrepreneur.
- Subscription: the periodic use of the digital family planner application for a fee.
- Right of withdrawal: the possibility for the consumer to withdraw from the agreement within the cooling-off period.
- Cooling-off period: the period of 14 days after receipt of the product (or for services: after conclusion of the agreement) within which the consumer can exercise the right of withdrawal.

Article 3 – Applicability
- These general terms and conditions apply to every offer from the entrepreneur and to every distance contract relating to the sale of the digital family planner and associated subscription.
- The text of these general terms and conditions is made electronically available prior to the conclusion of the agreement.
Article 4 – The Offer
- The products and subscriptions are clearly and fully described.
- If the offer is subject to conditions, such as introductory discounts or trial periods, this will be explicitly stated.
- When purchasing the digital family planner, the subscription is automatically activated unless otherwise stated.
Article 5 – The Agreement
- The agreement is concluded at the moment of acceptance of the offer by the consumer and after receipt of the order confirmation.
- The entrepreneur confirms receipt of the order electronically.
Article 6 – Right of Withdrawal
- The consumer may cancel an agreement regarding the delivery of the product (the tablet) within 14 days of receipt without stating any reason.
- The subscription to the application also has a withdrawal period of 14 days after the subscription is entered into, unless the consumer explicitly agrees to immediate delivery and waives the right of withdrawal when ordering.
- If the consumer returns the product, the subscription will be automatically terminated.
- Before returning the product, a fully completed Withdrawal Form must be submitted via email to retour@hivefamily.eu. This form can be downloaded from the website.
- Return shipping costs are the responsibility of the consumer.
Article 7 – Consumer Obligations During Cooling-Off Period
- During the cooling-off period, the consumer must handle the product with care. If damage occurs due to improper use, depreciation may be charged.
Article 8 – Prices
- All prices include VAT.
- Subscription fees are charged monthly or annually in advance, depending on the chosen subscription type.
- The entrepreneur reserves the right to adjust prices upon renewal of the subscription, with timely notification.
- The entrepreneur reserves the right to adjust prices annually based on the Consumer Price Index (CPI) as determined by the Dutch Central Bureau of Statistics (CBS).
Article 9 – Delivery and Execution
- The tablet will be delivered to the address provided by the consumer.
- The digital application will be delivered via download or activation link.
- The entrepreneur aims to deliver within 3–5 working days after receipt of payment.
Article 10 – Duration and Termination of Subscription
- Subscriptions are entered into for a minimum period of one month or one year, depending on the chosen subscription type.
- After the initial term, the subscription can be terminated with a notice period of one month.

Article 11 – Payment
- Payment for the product must be made immediately upon ordering.
- Subscription payments are automatically collected via the selected payment method.
Article 12 – Liability and Warranty
- The tablet is delivered with the statutory warranty, which means the product must perform as reasonably expected by the consumer.
- The entrepreneur is not liable for damage caused by improper use of the product or application.
Article 13 – Complaints Procedure
- Complaints about the product or service must be submitted in writing within a reasonable period via klachten@hivefamily.eu
- The entrepreneur aims to respond substantively within 14 days.
Article 14 – Applicable Law
- Agreements between the consumer and the entrepreneur are governed exclusively by Dutch law.
Article 15 – Refund Policy
- For physical products (the tablet): Consumers have the right to cancel their purchase without stating a reason within 14 days of receiving the product, in accordance with the Distance Selling Act.
- For digital services (application subscription): The right of withdrawal also applies to the subscription, unless the consumer has explicitly agreed to immediate delivery of the service and thereby waived the right of withdrawal.
- Refund procedure:
a. Report the return or cancellation within 14 days via retour@hivefamily.eu using the withdrawal form available on our website.
b. Send the tablet, if applicable, in its original condition and packaging within 14 days of notification to the specified return address.
c. After receipt and inspection of the returned product, a refund will be issued within 14 days, including any standard shipping costs.
4, Exceptions:
a. Digital content delivered with the consumer's consent before the end of the cooling-off period will not be refunded.
b. Damaged or incomplete products may result in depreciation.
c. Subscription fees after the withdrawal period will not be refunded unless there is an error on the part of the entrepreneur.
5.Method of refund: Refunds will be made via the same payment method used for the original payment, unless otherwise agreed.
